DUI Penalties in Colorado
The penalties for DWAI or DUI in Colorado are as follows:
- 1st offense – Up to one year in jail (DUI) or up to 180 days in jail (DWAI); fines and penalties of up to $1,000 (DUI) or up to $500 (DWAI); 9 month license suspension (DUI).
- 2nd offense – For both DUI and DWAI: up to one year in jail; up to $1,500 in fines and penalties; one year license suspension; interlock ignition device required.
- 3rd offense – For both DUI and DWAI: Up to one year in jail; license suspension of two years; ignition interlock device required. Up to $1,500 in fines and penalties (DUI) or up to $1,000 in fines and penalties (DWAI)
There is no so-called “look back” period in Colorado, and all prior DWAIs and DUIs are relevant for sentencing and penalty purposes.
