- $500 – $1,000 – Class 1 Misdemeanor, punishable by six to 18 months in jail and $500 – $5,000 in fines.
- $1,000 – $20,000 – Class 4 Felony, punishable by two to six years in prison and $2,000 – $500,000 in fines.
- Over $20,000 – Class 3 Felony, punishable by four to 12 years in prison and $3,000 to $750,000 in fines.
Colorado Defacing Property Law
Someone may also be charged with defacing property, or vandalism, in Colorado if they:
- Destroy, deface, remove, or damage any historical monument.
- Deface, aid, or permit the defacing of public or private property (graffiti), without the consent of the owner.
A first offense for defacing of property in Colorado will likely result in a Class 2 misdemeanor charge punishable by three months to one year in jail and $250 – $1,000 in fines. For second or subsequent offenses, offenders may face Class 1 misdemeanor charges punishable by six to 18 months in jail and a minimum fine of $750, up to $5,000. Those convicted of graffiti may also be ordered to repair the damaged property or compensate the owner for the loss if the property is not repairable.
