In most cases, after a record is expunged, an individual can legally say that they were never the subject of proceedings in Colorado juvenile court. Eligibility for Expungement

A juvenile record will qualify for expungement in Colorado if a court finds that since the end of the offender’s court supervision or parole:

  • They have not been convicted of a felony or misdemeanor, or adjudicated for another juvenile offense.
  • There are no criminal or delinquency proceedings pending.
  • The offender is considered rehabilitated.
  • Expunging the record is in the best interests of the offender as well as the community.

A record will not eligible for expungement if:

  • They were found to be an aggravated or violated juvenile offender.
  • They were found to have committed an offense that would be classified as an adult crime of violence.
  • They were charged, as a juvenile, by the direct filing in the direct court of an information or indictment, unless sentenced as a juvenile in the same matter.
  • They committed an illegal sexual offense.
