Some individuals with driving restrictions related to drug or alcohol use may be allowed to have their driving privileges reinstated before their normal eligibility date if they participate in Colorado’s ignition interlock program. If you or someone you know has been convicted of DUI, you may have heard about ignition interlock devices, mechanisms that are designed to prevent a car from starting if the driver has a breath alcohol content (BAC) over a preset limit.
Early reinstatement is limited to certain drivers, including:
- Residents of Colorado
- Those who were 21 years old or older at the time of the violation
- Drivers who have satisfied all reinstatement requirements (other than time)
Besides requiring a breath sample before the engine will start, such devices periodically require drivers to provide breath samples while driving, and if the device detects an elevated BAC level, the vehicle will not start or run.
Interlock Device Requirements
In Colorado, the interlock device must be serviced every 60 days, and an interlock-restricted driver who fails to report for servicing is at risk for license suspension until the driver is compliant again. Any such driver who drivers a non-equipped vehicle or attempts to disable the functioning of an interlock device is subject to license revocation and no driving for a minimum of one year.
