Colorado lawmakers passed the state’s first felony penalty for DUI in 2015, and the law carried harsh penalties, including prison time for anyone who has three or more DUI convictions on their record and is arrested for another DUI, regardless of whether an injury or death occurred.
Before the 2015 law took effect, a DUI conviction meant a misdemeanor punishable by up to one year in jail. In August 2017, Colorado legislators further bolstered the 2015 law by requiring that anyone convicted of a felony DUI spend 90 to 180 days in jail, and those eligible for work release face 120 days to two years behind bars.
